Terms of Service

HeuriSight (operated by Xopolis Inc., a Virginia C-Corporation) provides AI-powered learning intelligence and assessment services to educational institutions. By using our services, you agree to these terms.

1. Acceptance of Terms

By accessing or using HeuriSight's platform, services, or website, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Service

HeuriSight provides:

• AI-powered learning analytics and assessment platform
• Heuristics-Augmented Generation (HAG) technology for cognitive pattern analysis
• Multi-role dashboards for learning facilitators, instructors, and students
• Competency tracking and reporting services
• Educational data analytics and insights

3. User Accounts and Access

3.1 Institutional Accounts

Educational institutions ("Institution") may subscribe to HeuriSight services. The Institution is responsible for managing user access for their faculty, staff, and students.

3.2 User Responsibilities

• Maintain confidentiality of login credentials
• Use the service only for lawful educational purposes
• Not attempt to access data outside your authorized scope
• Comply with your institution's academic integrity policies

4. Data Privacy and FERPA Compliance

HeuriSight is designed to comply with the Family Educational Rights and Privacy Act (FERPA). We act as a School Official with legitimate educational interest when processing student data on behalf of educational institutions.

Educational records are:

• Maintained in secure, encrypted databases
• Accessible only to authorized institutional users
• Never shared with third parties without proper authorization
• Retained according to institutional policies

5. Intellectual Property

5.1 HeuriSight IP

HeuriSight's technology, including but not limited to our Heuristics-Augmented Generation (HAG) algorithms, platform code, and documentation, are proprietary and protected by copyright, patent, and trade secret laws.

5.2 User Content

Institutions and users retain ownership of all content uploaded to HeuriSight (documents, assessments, student work). HeuriSight processes this content solely to provide our services.

5.3 Generated Insights

AI-generated insights, heuristics, and analytics belong to the Institution/user who generated them through use of our platform.

6. Acceptable Use

Users may NOT:

• Attempt to reverse engineer or copy our HAG technology
• Use the service for any unlawful purpose
• Share or distribute student data outside institutional authorization
• Interfere with service operation or security
• Use the service to harass, abuse, or harm others

7. Service Availability and Support

HeuriSight strives to maintain 99.5% uptime. We provide:

• Regular platform updates and improvements
• Technical support during business hours
• Documentation and training materials
• Scheduled maintenance windows with advance notice

8. Payment and Subscription

Institutional subscriptions are billed annually based on agreed pricing tiers. Payment terms are specified in individual subscription agreements.

9. Termination

Either party may terminate services:

• With 30 days written notice
• Immediately for breach of terms
• Upon non-payment after 30-day grace period

Upon termination, institutions may export their data within 30 days.

10. Limitation of Liability

HeuriSight provides services "as is" for educational purposes. We are not liable for:

• Academic decisions made based on our analytics
• Indirect, incidental, or consequential damages
• Service interruptions beyond our control
• Third-party integrations or external services

Our total liability shall not exceed the annual subscription fee paid by the Institution.

11. Modifications to Terms

HeuriSight may update these terms with 30 days notice to institutional administrators. Continued use after changes constitutes acceptance.

12. Governing Law

These terms are governed by the laws of the Commonwealth of Virginia, USA. Any disputes shall be resolved through binding arbitration in Virginia.
